Who fills it in
A U.S. citizen, lawful permanent resident or U.S. national (the petitioner) files Form I-130 to establish a qualifying relationship with a relative (the beneficiary) who wants to come to or stay in the United States permanently.
Where it goes
File it with USCIS, online or by mail. The mailing address depends on where you live and whether you file it together with Form I-485.
Watch out for
- Use the 04/01/24 edition. USCIS says it may reject a form with missing pages or pages from a different edition.
- The fee is on the USCIS Fee Schedule page — check it before you pay.
- Online, each evidence file can be up to 12 MB (PDF, JPG or JPEG), so large scans may need compressing.
