About Form I-9
Who fills it in
Form I-9 verifies the identity and employment authorization of everyone hired in the United States. The new employee completes Section 1; the employer examines the employee’s documents and records them in Section 2.
Where it goes
The employer keeps it. Do not file Form I-9 with USCIS or ICE. Employers retain it for three years after the date of hire or one year after employment ends, whichever is later.
When
The employee completes Section 1 no later than the first day of employment. The employer completes Section 2 within three business days of the day employment begins.
Watch out for
- Use the edition dated 01/20/25 — the date is printed at the bottom of each page of the form and its instructions.
- Keep the completed forms together and protected: they hold identity document details.
