A sublease lets a tenant rent their home, or a room in it, to someone else for part of the lease. The original lease stays in force and the tenant stays responsible to the landlord, so the sublease has to fit inside it. Fill in the details and the agreement is laid out with signature blocks for you and your subtenant.

This Sublease Agreement is made on __________ between __________ (the "Tenant") and __________ (the "Subtenant") for __________ at __________ (the "Premises").
1. Original Lease
The Tenant rents the Premises from __________ (the "Landlord") under a lease dated __________ (the "Original Lease"). The Subtenant agrees to follow the rules of the Original Lease that apply to occupants, and nothing in this Sublease gives the Subtenant more rights than the Tenant has under the Original Lease.
Where the Original Lease requires the Landlord’s consent to sublet, this Sublease takes effect only once that consent has been given in writing.
2. Term
The Sublease starts on __________ and ends on __________. It ends earlier if the Original Lease ends for any reason.

The Subtenant will keep the Premises clean and in good condition, will not make alterations without the Tenant’s written consent, and will return the Premises at the end of the Sublease in the condition received, except for normal wear and tear. The Subtenant is responsible for damage caused by the Subtenant or their guests.
6. Tenant’s Responsibility
The Tenant remains responsible to the Landlord under the Original Lease, including for rent, while this Sublease is in effect.
7. General
This Sublease is governed by __________. It is the entire agreement between the Tenant and the Subtenant about the Premises and may only be changed in writing signed by both. It may be signed in counterparts and with electronic signatures.

Check your own lease first
Many leases forbid subletting or require the landlord’s written consent, and some cities regulate short sublets. Read the subletting clause of your lease before you advertise, and get any consent in writing.
- Keep the sublease inside your own lease dates.
- Give the subtenant a copy of the rules in your lease that apply to them.
- Take dated photos of the home when the subtenant moves in and when they leave.
